If someone is going to be taken to court, have they been charged?

Will try and explain a bit, DD's dad( my ex husband) grabbed her by the throat, held her up the wall yelling at her. We got child prtection involved, gave statements, then they went and took his statement. He said we lied and made it all up.

After looking over all the evidence child protection have decided to take it further and he will go to court. That's all I know so far, that and that we will go to court to give evidence. It was two weeks ago that I was told that this would be pursuded through the court.

Does anyone know roughly how long it will be before I hear anything else, and if he will now have been charged with assult, or can it go to court without him being charged?

He has been charged - via the Crown Prosecution Service.

Child Protection Services have solicitors (and barristers) immediately available and they will have given advice and support. The evidence given by Child Protection has been accepted and there is 'a case to answer'.

Do you have a case/incident number?

You can phone the police if you involved them. Alterntively, phone Child Protection and ask for an update.

I don't know if he has been charged, all I know is that we gave statements to a dc xx who works for child protection, she then took his statement, he said we lied. Dc xx looked over our statements, and his with her boss, and they decided they were able to take it further, and because I had asked them too, as there is another child who could be in danger if this happened again.

I do have a case number somewhere, don't need it tho as when I ring dc xx never asks for it, she knows who I am. She was away when I called, and I won't hear from her untill Monday, so I just wondered if anyone else knew the answers.

I am finding this very difficult too be honest, trying to be strong for my dd, but I am not sleeping, it's very hard, just want him to tell the truth and for this to be over :(

to go to court he would have to have been charged. i don't know much about child protection issues but with any criminal trial the police liase with the crown prosecution service and if they decide there is enough evidence they will send it to court.
this doesn't mean he has admitted it or that he will be found guilty but it does mean there must be quite a strong case against him. i don't think this sort of stuff is confidential and i think the police will tell you what is going on if you phoned them.
these things can take months or even a year for the final outcome especially if he gives a not guilty plea and it goes to trial.

p.s im sure the truth will come out or he will get scared and admit it. if he gives a not guilty plea and gets found guilty he will face a stiffer sentence than if he admits it and shows remorse so im sure he will.
