Hi

I was wondering if someone could help and advise me what are the consequences if anything for filing a witness statement later then ordered by the court?

My partner is representing himself and doesnt really know how it all works but his ex partner/solicitor hasnt filed their witness statement at court yet and it was due on monday. We made sure his was there in plenty of time and a copy was also sent to them on time.

Could you tell me if the judge will be aware of this or if we should make it known? they were also responsible for starting the ball rolling on an application to the local supported contact centre which we have been keeping an eye on via calls to the contact centre and so far 5 weeks since court they havent attempted to do anything.

What were concerned about is his ex is doing and will do anything to delay contact starting (she lied at the first hearing about him being a drug user and insisted on hair strand testing before contact could start) we are unsure if they have even started the ball rolling for this yet either,

Is there a way we can share our concerns with the court, were back in court in just over 4 weeks and it was ordered the test results be back at court in 3 weeks. he just wants to see his children without all the silly games.

Any advice or suggestions would be really grateful

Thank you

Write a letter to the judge, drawing attention to your concerns that the directions given at an earlier hearing haven't been complied with. Ask that the case be listed for urgent directions to deal with it. You may find that copying ex's solicitor in to this will result in a statement being filed and contact centre started.
