possible divorce and leaving UK for a month

My husband an due are going to separate for a month to "think about the relationship" (at my husband's "request").

He wants me (6 months pregnant) and the kids to visit my family in the European Union. A country where settlements are not that great for the main carer (me).

  1. question: Would it be possible if I visit my family in "my" country that he could file for divorce in that country while I am there exiled for a month? [We got married in my country, bust have always lived in the UK and are fully based here. I have a couple of bank accounts (since childhood) in my country still. I visit my family 3 times a year.]
  1. question: I also have a friend in the Netherlands... she would host us for a couple of weeks, could my husband then file of divorce if I go on holiday in the Netherlands (with no ties whatsoever to that country?)

I would love some help!

Jurisdiction is based on the Brussells II regulations.

This bases jurisdiction mainly upon habitual residence, so going there for a month doesn't count. Make sure that if you do go abroad then you have a return flight booked as proof that you intended to return. I'm assuming you are both of different nationalities. If you are from the same country either of you could apply for divorce in that country.
