My parents are splitting up after 41 yrs of marriage, my father has decided a Chinese women younger than me is preferable to my Mother. He has agreed to give my mother the house in the UK, half his salary and half his pension. She wants to ensure that this is legally binding before she will leave China. How can she do this?

If they are both UK nationals they may actually be domiciled in the UK, in which case they could get divorced over here.

PosieParker · 17/04/2012 12:57

Thanks. They will not get divorced as my mother doesn't want to and my father cannot site unreasonable behaviour, so I think that will take five years. However at this moment in time my father says he will give my mother the house, she is worried unless she gets this 'legally' it will be something he later takes away and she will only get half. So can she just go to a law firm in HK that practice English law and draw up an agreement?

They'll need to get it into the uk jurisdiction and then get a consent order here if they want it to be legally binding. If you message me I can help you check whether there is uk jurisdiction and help from there. Possibly get a separation agreement in the first instance, which I can draft.

Thanks!!! I'll try and call my Mum today!
