Sub contractor has threatened to dig up road he hasn't been paid for

We had a house built in 2010 and paid for it with several staged payments. The last payment was "upon completion" of the house. All payments were made on time. after the builder failed to complete all of the house and the snagging list we served notice on him. We withheld a small amount to get the work completed/snagging done. We paid him close to £340k and held back c£14k. We have had 2 sub contractors whom the builder employed come after us for payment. The most recent today who says he is going to dig up the Tarmac he laid (to make good the road outside our house which had to be dug up to build the house). This piece is half ours and half the highways. Can he do this????
I have informed the police, planning and highways and I am trying to speak to my solicitor

Your solicitor, who knows more about your case than any of us, will be best placed to answer that one.

Turns out it would be criminal damage, I've now put police on notice
