Very ex tennant using my address as his bail address

A bloke knoced my door a few weeks ago saying that he used to live here years ago. I recognised the name, and he did live here as a child/teen.

He said that his car insurance had cocked something up and were sending his new policy here. I must have been having a thick day because it never occured to me that this was odd. I said i'd not recived anything but if i did i'd ring hm.

The next day an envelope came and so I txt him and he fetched it and said that should be it now. The following week another letter came and i txt him again and he fetched it. I was starting to get suss by now so when another letter came i held it up to the light and could see the words prosecution and court.

I didn't contact hm about this letter or the one that followed. Anyway today another letter has come and I have opened it and he has given this address as mine and his bail condition is that he lives and sleeps at this address.

Now what do I do ?? I could txt him and say I know what he is up to, but seeing as he s up for an assualt charge i think thats a bad idea.

I know i am not supposed to have opened his mail but whatelse was I supposed to do.

Decided to ring the non urgent police number. They took my details and are ringing me back.

Oh I know, my life is complicated atm that I am not exactly surprised lol.

Someone just rang me back to ask me for some details from the bail form. He has to sign today so hopefully if he hasn't been in yet they can nab him when he goes to sign.

Right, they have rung back again and said they want me to send this stuff and any further stuff back to the court it came from, explaining that the named person doesn't live here.

Thought they might have sent someone round to get the stuff tbh but nevermind. Will post it all back on Monday with a note explaining why.

Right, change of plan. Just told my dad and he is not happy at the police reaction at all.

On Monday I am going to take the stuff into my local police station which is also the station that this bloke is bailed to. I am going to explain that I am a single person living on my own with 3 children and that I am not happy to just return and mail sent to me and that I want them to sort it out. This bloke is up for assualt and knows my address and moble number fgs.

Isn't it an offense to open mail addressed to other people?

Be careful about taking it to the police station and kicking up a stink as they may just throw the book at you to be perverse! You are in a no win situation

The return to sender thing is the correct thing to do from now on even if you are worried /-:

If he has bail conditions then he has been charged to appear at court not at a police station. The bail conditions (which may include signing at police station) may have been set either when charged at the police station or when he first appeared at court.

You are best to send the documentation direct to court as they can then issue a warrant for his arrest for breach of bail. Also best if you can take it there personally and it can be dealt with alot quicker .

Either by taking it to the court or the police station they guy is going to know you dobbed him in. I am surprised that an address check wasn't carried out by police or court to see whether he still lived there - he must have given an address when arrested - police should have checked that out aswell before releasing him.

Somone either in court or police has made a cock up.

sorry to post to soon,

my xp was arrested for assaulting me and was bailed to the station while the police made further enquiries including seeking a cps decision regarding whether there was enough evidence to charge him. during this period he also had bail conditions imposed not to contact me or go within 100m of my home address. he wasn't charged until 3 months after being arrested but the bail conditions were valid from the day of arrest.

He is bailed to sign at my local station every saturday between 12-2.

The thing is, if i post to the court how i will i know if anything has actually been done. I can't take t up either as I have school stuff for the dc every flippin day next week. My local station is only a short drive away and i'd rather know someone was dealing with it in person.

I am really not bothered about being caught opening his mail. I looked that up and apparently if you had good reason to think someone was comitting fraud etc then they don't prosecute.

If I am advised on Monday that I need to send the stuff back then I wll, but i want it on file somewhere at my local station that I have been in and spoken to them about it.

Take them to the police station ask them to copy them and then send the originals back to the court?

Pre charge bail is normally imposed in cases of domestic violence and needs advice from CPS to do so. ( as in yourcase someday )

It is not the norm to bail someone pre charge with bail conditions.

yes I do know that you can be bailed to appear at a police station after arrest and release but before charge - I dont think I said any different

Nutcracker Am sure you will but do take photocopies of everything - I would send the originals back to the court with a letter, keep a copy of the entire set for your own records, and take another set into the local police station.

Phone the court and explain what has happened - you may need to fax something over before/after you put in the post - are you able to do that? Either way, depending on whether on police or court bail you need to make them understand that someone is using your address fraudulently and in reporting them you open yourself up to the risk of assault/further criminal behaviour from this person. Can't understand how proper police checks (DVLA/electoral roll/council tax etc) would establish this person at your address.

Thank's all. I am not at all surprised that this has happened. I have lived here for 7 years now, and it took ages for the police to realise that this famly has moved out.

I complained to the police about 5yrs ago because they banged on our door at 5 in the morning with loads of police to look for one of them members of this family. At the time they said that we weren't listed as living there but the old people were. That was a lie because i checked the very same day.

Not sure my scanner is working, but if not i will get copies made of everything yeh.

I soooooooo don't need ths hassle atm lol

I don't know if this is the right thing to do or not, but I'd be inclined to just mark the envelopes 'not known at this address, return to sender' and pop them back in the post box. Then if he contacts you again, say very nicely that you haven't received anything else, but you'll let him know if you do (not). Then leave it up to the courts to sort out.

Send them recorded delivery if you're able to get to the post office, it'll be worth the 75p to know that they'll def get back to the court. If the police station make copies they can certify them as originals that's why I said go there and ask them to do it.

Update : I went to the police station and they took it very seriously. I had to give a statement and have agreed to give evidence in court if I have to.

They have given me a number to ring if i either have any more letters, or any other contact from him, and said to ring 999 if I felt threatened by him at any point.

All of the info is being sent to the officer in charge of his case and he will be arrested for breachng his bail conditions.

Unfortunatly not. Have had a letter from Kwik Fit today addressed to the mother of the bloke, and she is using my address on her car insurance.

I am going to ring them tomorrow and fill them in on the situation.

You can ask the post office to only deliver things that are addressed to you. That way anything addressed to them will be returned to sender. Might save you a load of hassle.

Is it possible to have a flag placed on my address to state 1000% it CANNOT be used as anybodys bail address?
Also, is it possible to find out if it has ever been used as a bail address, and if so who by and when?

You should really start a thread of your own rather than revive a thread that is nearly 13 years old. People are likely to answer the OP, not realising that this is an old thread and missing your question.

However, to answer your questions, no it is not possible to put such a flag on your address, nor is it possible to find out if it has ever been used as anybody's bail address.
