Moisturiser I've bought online gave me an allergic reaction- can I get a refund?

I bought some moisturiser which has given me an allergic reaction. When this happened when I bought from a bricks and mortar shop I got my money back.

The online retailer is refusing a refund as the tube has been opened.

What's the legal standpoint? Does anyone know?

All sorted. Contacted Trading Standards and now have a verbal offer of a refund.
