DH insurance company says he has a MS90 he doesn't know about

Dh had a car accident a few weeks ago, his fault.

His insurance company have contacted him to say that he did not declare an MS90 (not declaring driver details) conviction on his insurance policy, which he got in 2007.

He knows absolutely nothing about it. Never received summons, never informed of points or fined, no warrant for execution, nothing.

The insurance company are now refusing to pay as he didn't fully disclose.

Is there anything he can do?

You need to get the insurance co to send details of the conviction and take it from there.

They have sent details, in that is was an MS90 in Feb 2007.

sorry, pressed post too quickly!

He literally knows nothing about it - and it was nearly 4 years ago so no idea what it is about.

He's had speeding offences since and it has never appeared on his licence, and he has never been chased for fine or anything.

then get in touch with DVLA. they will be able to give details of the convicting court and dates etc.

4 years ago is rather a long time to challenge it though i would have thought. i think you would need to speak to a specialist motoring solicitor about it.

Thanks. It's the insurance claim that's the problem.

How could he disclose a conviction he knew nothing about?

Even if the conviction is valid, presumably he can't prove he never received notification of it.

Google "MS90 conviction" and look at all the links. It could have been a clerical error by the Police.

How many cars were owned and registered to him in 2007? Have the Insurance Company given you the registration number of what the MS90 refers to.

No they haven't. He is ringing the DVLA tomorrow.

He has googled but it only says what to do if you receive notification that you've got one. Which he never did.

Did he own his own car outright, or were any of his cars leased or company vehicles?

Could it possibly relate to a vehicle which he had sold, but DVLA had not changed the ownership details correctly.

ell it seems a bit dodgey - as the insurance comapny have picked a penalty that of ourse soemone may not know about.... as that is what a ms90 is not knowning who the driver is and it oculd ave been any driver

Possibly. He changes cars quite often. It's sound ago I can't remember.

He's sent hisicence off to DVLA since and the points haven't shown up. I also imagine he would gave been chased for the fine before now.

His car was written off in 2008, 18 months after offence, although I don't see why that would make a difference

It is just possible that, although it was written off, the car and its registration number were sold and used again.

Confused. Have just rang my insurers as DH is a named
Driver.

They have no record of ms90 and it doesn't show up on their police database. The insurance guy was flummoxed.

Sounds like the first insurance company have made a mistake.

You need to get confirmation from DVLA that this conviction is not on DHs record then give proof to ins co.
