Background. (Sorry long txt)

3 ICSI cycles.

1st - 2016 not successful . Very poor fertilisation rate 3/16 . 3DT Poor quality embryos.

2nd - Successful - consultant changed our stimulation meds. Perfect fertilisation 10/10. 2 top quality quality blastocyst. 5DT

3rd - During our conversation the consultant told us we should use the same protocol and same stimulation meds as the second cycle. I explained that I recalled using Menopour and Gonal F but didn’t recall when I used each (1st or 2nd cycle).

The consultant went through the paperwork to identify which stimulation medication we used during the 2nd cycle. We went ahead with what was prescribed trusting it was the correct medication we requested and the doctor himself advised me to be on.

Unsuccessful fertilization rate 8/16 all poor quality embryos. 3DT

Recently had asked the consultant (not the same one but same clinic) to review our 3 cycles. We also asked her for advice on what to do for a 4th cycle.

She went on to say that our second cycle was significantly better and advised us that for a future 4th cycle we should use the same medication that was used in our second cycle as this had given us significantly better results!

We kept telling her that the medication we used in our 3rd cycle had to be the same as the 2nd cycle as this was what the previous consultant had advised us and told us he would prescribe. After checking everything she explained to us that we were not prescribed what we had agreed with the consultant.

We kept asking the consultant, why would previous consultant prescribe us something other than what had better results for us; to this, she kept answering “I don’t know”.

This information has had a significant impact on us. Having to go through fertility treatment is draining in many areas. Finding out that we did not have the best treatment for us because of a prescription error is devastating, to say the least.

Has this happened to any one ?

It’s a NHS clinic that also takes private patients like us. We have complaint through Pals and are waiting for a response within 25 days.

Wondering if it’s worth getting legal advice 😣?

Have you tried complaining through the clinic?

I put a complaint into my clinic in 2018 which like yours was an NHS clinic but also took on private patients.
They were pretty quick in responding (probably quicker than PALS) and although they never admitted liability. They offered a few goodwill gestures. At the time, it was best for me to move on, so i accepted.

The other option is to complain to the HEFA (or HFEA, i get it mixed up)
