What is this about Trump pardoning his children for future crimes?

I can find a lot of stuff about him discussing the option of issuing pre-emptive pardons.
This has to be a joke, doesn't it?

He can’t do it though. He can pardon someone who has been convicted - that’s why he will be clinging onto the Oval Office door by his fingernails in January.

They said on radio 4 yesterday that he could try doing this, something about it’s been done before?!

ThatIsNotMyUsername · 03/12/2020 15:58

Sounds like when a criminal tries to arrange a deal with the police - gives up information on someone else and so that their crimes will be dealt with leniently (can’t let people get off Scott free for unspecified crimes though can they?) - but who would they offer up as a scapegoat (although I suspect people are probably queueing up to offer themselves up to spill the beans on him).

AmandaHoldensLips · 03/12/2020 16:00

Did anyone see his ranting address from the white house yesterday? The man is a raging despot attempting a coup. And while it's easy to laugh at his lunacy, we have to remember that 70 million americans voted for him.

No way is he going to concede. Every single one of those trumps belongs in jail.

AmandaHoldensLips · 03/12/2020 16:01

And god knows how much evidence they're busily destroying before setting fire to the place on the way out.

ThatIsNotMyUsername · 03/12/2020 16:03

But people will be squirrelling away the evidence to cover their own backsides though won’t they?

Besides - electronic comms are never truly deleted.

StrippedFridge · 03/12/2020 16:17

They said on R4 that he can only pardon federal offences not state offences, e.g. ones brought by the state of New York, so the pardons will be of limited benefit. Of course the biggest crimes tend to be federal not state so it's not all good news.

Mrsjayy · 03/12/2020 16:23

It was his mate Rudi the day before they are all sweating buckets! Allegedly there was stealing from a charity to fund trumps campaign. And there has also been deals with China to do with ivankas business or something. So yeah he will want to issue parsons

Mrsjayy · 03/12/2020 16:24

Bloody hell! PARDONS

ThatIsNotMyUsername · 03/12/2020 16:24

Ah yes - ivanka has been questioned about that today hasn’t she? Using charity money for a $250k political bash wasn’t it?

Mrsjayy · 03/12/2020 16:30

I believe so thisisnotmtusername

The extent and nature of Presidential pardons have not been intensively tested in US courts. So far they've been viewed as viable, but only through default, not through challenge.

However a pardon can be a burden as well as a blessing since it's unarguably a manifestation of immunity from prosecution. And there is long established case law at all levels in the US that provision of immunity from prosecution removes a witnesses right to claim protection under the fifth amendment.

TL;DR this means that anyone pardoned by Trump - including Trump himself - could find themselves going to jail for refusing to testify in cases involving other people.

It's an interesting state of affairs.

AmandaHoldensLips · 03/12/2020 17:52

And all the people donating money to trump's legal fund to "overturn the result" probably don't realise that he can use it for his own personal expenses. They're paying for his enormous debts. It's mind-blowing.

The Farage plan ....
Mrsjayy · 03/12/2020 18:55

How did Farage (the king of Europe) get involved with trump that was just odd ?

Cut from the same cloth ?

Nigel has gone quiet of late.

AmandaHoldensLips · 03/12/2020 19:02

Farage isn't overly fussy about who he gets into bed with and trump probably feels a certain affinity with another hated man. That's why trump admires dictators. They don't take any shit from any one. They just shoot them.

Mrsjayy · 03/12/2020 19:13

I just don't understand how their paths would cross although.Farage was involved in his UK visit wasn't he ? Yeah last I heard Nige he was telling morning TV that he was on a media visa and was working in the states Ben shepherd didn't even ask that questionConfused

prh47bridge · 07/12/2020 07:59

There appears to be some misunderstanding here. Trump cannot pardon anyone for crimes they have not yet committed. The term "pre-emptive pardons" refers to him potentially pardoning people for crimes they have already committed but where they have not yet been charged, let alone convicted. A pardon cannot apply to future conduct, only to past actions. Also, as StrippedFridge says, a presidential pardon only applies to federal crimes.

Mrsjayy · 07/12/2020 10:44

There has been no misunderstanding on thread we know all that, however president Trump seemed confused about the process.

prh47bridge · 07/12/2020 11:28

Look at the thread title. The OP appears to have misunderstood.

One poster thought he could only pardon people who have been convicted, which is not true. Another poster isn't entirely clear but what they have posted suggests they may have understood "pre-emptive pardons" to refer to future crimes.

prh47bridge · 07/12/2020 11:29

I do, however, accept that most people on this thread appear to have got it right. I posted without reading the full thread.

StealthPolarBear · 07/12/2020 11:45

As the op I can confirm yes there was misunderstanding. Thank you. Not much better but slightly better than what I'd assumed.
