And although I don't know her personal circumstances of course, at 28 years old she really should have known better

Interesting charge..... just googled this:-

"Child Destruction" is from the 1929 Infant Life Preservation Act, which defines the crime as any willful act causing the death of a child capable of being born alive.

So she's being charged with murder and child destruction. Was the child born alive or does it's immediate death bring in this second charge?

The man arrested was an employee of the pub, who found the baby - poor guy! In a belt and braces approach they took him in and questioned him for quite some time, before releasing him.

I thought in the UK the law doesn't consider neonaticide as murder? (on the grounds that woman can become unhinged by childbirth)

Tallulah, I think infanticide is a defence to a charge of murder - I think (though someone please correct me if I've remembered this wrongly) that you need to show some kind of PND/post-partum psychosis to get the charge reduced to infanticide, otherwise it would be murder.

though it's pretty hard to imagine a case where the fact of the child being killed isn't evidence enough in itself of the mother's unhinged state of mind.

Agree it very hard to understand how someone that age could have done this.
