She's still alive, yes. A bullet passed through her brain, so the surgeon is optimistic about her survival, but who knows?

One of her aides is confirmed dead, the 9-year-old girl and Judge Roll, age 63, appointed in 1991 under the first Bush administration.

You can have a bullet lodged in your head and recover properly. I knew a guy who had. It was in his cerebral cortex, too. The only residual problems he had 5 years on was one eye permanently crossed and stunning headaches.

Because of where the bullet was located, operating on him to remove it was deemed the worse of two evils.

But it's a necessary evil because my dad's too old to come here anymore.

you know, drugs, car accident, abusive boyfriend.

but hers includes school/college shooting and cults.

Just seen an update: the main culprit has not been named officially, just a 22year old with mental and criminal issues. Police are actively searching for a second suspect.

One of the dead is a 9 year old girl. I expect many other sadnesses will emerge.

RIP to all who were just in the wrong place at the wrong time.

He will face a federal court first, for the murder of Chief Judge John Roll and the federal employee Gabe Zimmerman, as well as the attempted murder (assuming she lives) of Representative Giffords.

Yes, the federal criminal justice system does have the death penalty but it's up to the prosecution to decide to pursue it.

Federal sentences don't have parole, so whatever sentence is given is the sentence the convicted will serve.

The charge of murder will likely be life imprisonment or death.

The state may chose to bring charges after he's been tried by the federal court for the other murders, but he won't get out of federal prison for the murders of Roll and Zimmerman.
