Tax credit/ childcare element.

Somebody asked about this the other day and I'm not sure anybody knows the answer. Doesn't affect us atm but may do one day.

So if you have a H.ed child of school age who is receiving childcare during the day whilst you as the parent are working.
Are you entitled to the childcare element of Tax credits? Or is this disallowed as school is available as a form of free childcare?

Anybody who knows the official response?

Definitely allowed.

There are no restrictions on what time of day the childcare happens. As far as I know, the info you must submit does not even require you to specify precisely what time the childcare happened, so how would anyone at Tax Credits even know or care whether the child is HE?

The official line is that school is education and NOT childcare. Never mind that many parents do actually use school as part of their childcare arrangements; that is not supposed to be its primary function.
