Can my kindle be fixed?

Had Kindle touch just over a year and the button that takes you back to the menu no longer works. I have done a reset thing (holding the on button until the kindle screen appears) a few times and that takes me to the menu but still the menu button itself doesn't work so I can open a book but can't get out of it. Can I do anything about this? If not what happens to all the books I have on it? Thanks

Thanks, I didn't think they would as it's out of warranty but they have agreed to as it was only just expired. Thanks for the advice - really impressed with amazon on this one!
