hi

I ordered one of these through a company called Mobile Phones direct on 16/10/10. This morning I got an email saying they still had none in stock and would email again on 12/11/2010. I signed up for a contract with T Mobile (who I'm with already) and the handset was free.

My questions are

  1. When and how will the new contract start with T Mobile ?
  2. Can I legally cancel this order and go elsewhere?
  3. Are they just in short supply anyway?

Thanks

I'm fairly sure there was a delay in the release of these in the UK. I remember someone else getting quite excited that one was due in the next couple of days and was then rather disappointed when it didn't show.

See that thread there was a website report about Vodafone delaying the release a week to 22/10 and if I am right, Mobile Phones is part of Carphone Warehouse so there may have been a delay in getting the model you want (not sure but I think they don't lock them to particular networks, so maybe the first lot to arrive were for Vodafone only, and Mobile Phones direct may have still been waiting).

You could contact them and ask if there has been any change in the date as you may wish to cancel (just to give them a slight kick and forewarn them that if you don't get one soon, you might try elsewhere). Would surely do no harm, and might get you a bit of priority treatment!

As for the contract, I would expect it to be dated to coincide with delivery - would be an unfair situation and they'd have the OFT (or whatever they are now) jump on them from a great height as being nasty to a consumer.

Mobile Phones Direct are a reputable company (well, as reputable as a mobile phone distributor can be Wink), so it does sound like it has been delayed due to lack of stock. Is it an HD Desire, or just a normal one?

Give them a call, I think you can cancel your order but depends on the T's&C's of your individual contract.
