Boundary advice - wind damage

If next door's unpruned tree (about 15ft high and bushy) blows against our fence and brings it down in this wind , can we expect them to pay for a replacement ?

Would you be able to prove that the tree knocked the fence down and that the wind didn't blow it down by itself? Is the fence in a good state of repair?

Depending on the circumstances you might have a good case, but it probably won't be good for relations.

Well it seems to have survived the night so no disputes yet. It is a fence panel that was replaced after last yera's stornm so pretty new. House is being sold anyway which could throw up all sort sof boundary confusions, just as it did when we bought ours.

I think you would only have a case if the tree was in a poor state and that you had warned them to take action - to which they had ignored, thereby showing they were negligent. Otherwise, I would ask them to go halves if need be!
