who is responsible for tree branches?

We rent our home (have been here for 8 years) and we hardly ever bother LL as we do most jobs ourselves. The house at the back of us has a large old tree, the branches of which hang over a part of our garden and next doors. As time has passed obviously the branches have grown and grown and now cover a much larger area.

The neighbours which land the tree is officially on have had a tree surgeon out today to trim quite significantly the branches on their property - as the tree is rooted on their land are they also responsible to ensure that the branches covering our garden are also trimmed? Or is it us/LL?

Why don't you go round and speak to the neighbours ? Tell them that you are happy to allow their tree surgeon to come into your garden to acres the tree and cut the branches on your side

All they can do is say no. But they are risking you going out with a saw and doing a terrible job , so if they want their tree to look nice they should say yes .

Your lease should say who is responsible for maintaining the garden - you or landlord

we are responsible for the garden - I know legally we can cut the branches overhanging onto the garden, but who is legally responsible for these branches?

BTW you can't make them trim it .

But they can't stop you going out and just hacking off the branches that are over your land . So a smart person woudl have the tree surgeon do it if, you give access

Do you mean who owns the branches - the neighbours do.

Strictly speaking you should chop them off and give them back . However most people just dispose of them .

However we've just paid our neighbours gardener to cut back the branches which overhang their garden because we are doormats and they asked

Go round and offer them access to trim your side, offering to pay the extra.
