Neighbours ivy and my fence

Hi, If a neighbours Ivy damages my fence is that classed as criminal damage, she has intentionally planted it and left it to grow out of control and now my fence is twisted, mangled and is probably being held together by said Ivy!

I have tried cutting it down to a reasonable level but it is impossible and she cries and moans about it ( I would like some sunlight in my already over shaded by her huge tree garden!)

Where do I stand? I cant afford to replace the fence and it is them that has damaged it.

Thanks :)

Can you prove her intent was to damage your fence?

No but she is old enough to know how damaging Ivy is. And she has never cut it back.
