Can you claim CHC retrospectively after death?

MIL had been in a care home for 2.5 years and finally passed away from vascular dementia on Saturday. I know that people can claim when near to death but nothing was mentioned to us by the care home. We tried to claim 2 years ago when she first went in but were rejected. Can we retrospectively claim for those last weeks before her death?

You will need to show that your MILs needs were health based and that she was not only receiving social care.

The executor/administrator of her estate will need to write to the Integrated Care Board (ICB) responsible for the area where she received care and request a retrospective assessment.

You'll need to explain who you are and what legal right you have to act on behalf of the patient or their estate. You will also need to provide details of the care provider and dates of care. Finally, you will need to go into why you believe CHC funding should have applied.
