If capacity has been lost, and there is no power of attorney, how do you go about organising local authority funding for care?
Probably just over the threshold to have to contribute with cash in the bank. No assets. Experience welcome

Shit position, I found myself in a similar situation but with lots of assets locked away. You need to speak to your local adult social care team and explain the situation. They will be used to dealing with such cases. Policies may differ authority to authority. Some will in effect ‘loan’ the money (with interest) to be repaid later from the incapacitated person’s assets. Legally, you/the council need to apply to the court of protection for access to the funds, but quite frankly it’s ridiculously expensive and takes for ever, although there is a fast track opt to apply for a specific expense, so that might be the best route.
