Council insisting on financial info whilst CHC decision pending

local council are demanding financial info in respect of my mum who is in s care home. She was assessed for CHC in Msy and we are still awaiting that decision (have chased several times). Anyone know what the regulations are in respect of this and if the council are entitled to financial info whilst a CHC decision is still pending?

Hi op, they will be funding the care and need to financially assess to whether your mum should pay the full cost or an income based contribution. If CHC is granted, the NHS will refund you.

I'm not aware your family or even your parent's savings have any bearing on whether they get NHS Continuing Healthcare - by which, of course, all their care needs are met by the local authority or NHS CCG.

In practice it maybe does, seeing as the State will not be putting its hand in its pocket where it can be avoided.

If you are talking about funding care in a care home then it comes down to whether your parent has savings of more than £25K or thereabouts. If they do, they pay for all of it, charmingly, until your inheritance (nearly) runs out.

Incidentally, if the son or daughter went on to be millionaires, they do not have to pay a penny towards their ailing parent's care - though chances are they will be pressed into forking out for top up fees.

Whilst ASD are funding care, it comes under LA charging policy.

If CHC decision or assessments are pending, that team will give you date of handover of funding, if/ or once agreed as eligible for.dull CHC funding. It's quite high criteria. It's worth keep chasing that CHC team for outcome.

(Just out of interest, have you had the Multi disciplinary DST (Decision Support Tool) meeting? )

The LA will give you a copy of their Charging policy booklet.
