Advice needed for a successful appeal.
So My daughter had a secondary school place beginning September 2024, she attended but wasnt coping very well this was due to her mother passing away in the (summer holidays 2024) the school weren't really understanding about this and they were more bothered about attendance,so I took my daughter out of school and home educated her,know she wants to go back to school and I feel it's in her best interests to go back but the school have refuse her a place stating there a full. No other secondary schools in area and really need help to appeal this. Can anyone advise me please 🙏

LA has to offer a place or use Fair Access Protocol to find one. You can appeal against refusal but it will take time and you will need to demonstrate specific reasons that she needs the school.

And where is she on the waiting list?

She isn't on a waiting list they just point blank said no we are full.The thing is this was the school she had a place in before I took her out,she has all the uniform/equipment for this school,I'm a single dad with not alot of money,also just want the best for my daughter and he wellbeing.

Did you phone the school and ask for her to go back or did you apply via the council's "apply for a school" procedure? You need to go via the council and they have a duty to find your daughter a school place.

I applied through the schools in year addmissions which is connected through our LA,this is the only school in the area that is suitable but the school states there are full,I have a right to appeal but need help with this to be successful.

So has LA offered an alternative?

No Alternative,Just and option to appeal,the school states there are full, I took my daughter out of said school to home educated her,as she wasn't coping very well after her mother died the school weren't very understanding and were more bothered about her attendance and threatening to fine me for her not attending. Know I feel it's in my daughter best interest to be back in a school setting with her friends and she feels it would be better for herself. I just need help in appealing the decision advice and pointers, I just feel like no one is help me 😫

Call LA and ask for a school place offer, waiting list position and if FAP applies. You can still appeal. However you need to be careful, if you withdrew due to lack of support, arguing that this is the best place available and be very specific why.
