October birth. Do fines start after October half term or Xmas?

Hello, my daughter is born October 2019. We are looking at our of term holidays and I heard you don't get fined till the term after they are 5. She is 5 in October before October half term.

Does this mean I will be fined after October half term or after Christmas?

Trying to figure out if we can go away November without the fine.

I think (though could be wrong) that local authorities are in charge of this kinda thing. You're best off checking the school's absence policy, they'll definitely have one.
