EHCP drama l- WWYD!?

Okay so basically I named as my parental preference on my daughters EHCP a special provision unit within a mainstream school, the senco from that school came to visit daughter at nursery after they were consulted.

my case worker came back and told Me that unfortunately that school said they could meet her needs but they were full. So obviously I was gutted but had to think of plan B

well on Tuesday I found out she's been allocated the mainstream part of that school and her teacher at nursery told me
today to give the school a call and make sure she's on their enrolment list, bevause she has an EHCP she might not be.

so I did and I got put though to the senco who I know from Visiting the school twice before.. well I said to her just in general conversation "I know you guys were consulted for the unit but you said you could meet need but we're full" and she laughed in disbelief and said we are not full, we have 3 spaces still. I don't know why they would tell you that" We would be the perfect fit for your daughter you need to fight it.

You have got a mediation certificate, completed the SEND35 form and collected the evidence to send in the last 1.5hrs?

You don’t need to go through mediation to submit an appeal. I never have.

You don’t have to actively partake in mediation, but you need a mediation certificate in order to submit to SENDIST. Unless OP is only appealing section I, which is a mistake if she wants an ARP. She should appeal B&F as well.

The mediation company’s details will be in the letter the LA sent with the finalised EHCP. You need to appeal B&F too. Section I is the logical conclusion of B&F and for most ARPs the mainstream school is named in I and the ARP included in F. B&F are likely to need improvement anyway.

You should have received a cover letter with your final EHCP, that will give toy details on how to get your mediation certificate. Your appeal will be rejected without one.

The whole situation is an extremely stressful situation. I have a daughter who is almost 4 who needs my full attention, but I'm also desperate to get her the right education which I'm trying to do as well as keep her occupied so I can fill out forms, write emails and make phone calls and I just don't understand all the abbreviations and extra forms and what not, it's a lot. Throw on top of that school runs for my 9 year
old and an 18 month old as well running around. I feel like I'm going to crack 🥲 I feel like all the pressures on me too because I barely understand it all myself
let alone trying to explain it
to the OH so he can help 🤯 and then I also have to go to work in the evenings and talk
to the public as though im not on the verge of a nervous breakdown

I’m sorry you feel overwhelmed. Take a breath. You can do this. @Skiphopbump mentioned IPSEA, they are very helpful. As is SOSSEN. IPSEA and SOSSEN are charities who support parents with SEN matters.

LA = Local Authority

SENDIST is the Special Educational Needs and Disability Tribunal. The Tribunal who hears your appeal.

A SEND35 from is the name of the form you complete to send to SENDIST in order to appeal.

ARP = additionally resourced provision also sometimes known as enhanced resourced bases/unit or cabins or whatever your LA calls them. It is the type of provision you mention in your original post - “special provision unit within a mainstream school”.
