The school- they have to report to the local authority for them to issue a fine, it's not done automatically by the LA, it's down to the school to raise it.

They get the details from the school- school fill in a form with parents details on. Both parents are meant to get a fine each, at least in my county, even when they both live with the child. So strange he hasn't got one.

Yeah ok unless it comes tomorrow in the post which it may do i suppose. I just wanted to make sure that one was not being sent to my sons bio dad as he has had no contact for 10 years and there was dv on his part i was just worried with it having my sons address and school on the letter

Hello, school admin here. Generally a fine is sent to both parents if they both have legal parental responsibility. If your husband hasn't been granted legal PR by a court then he wouldn't get a fine (even if the school generally treat him as 'dad'). If the school don't have contact details for your ex, then they can't pass them on to the council. If they do, then it will be at their discretion. I would hope that if there is a history of DV and no contact, then they wouldn't involve your ex even if they do have his contact details.

Unless your husband has PR he can't be fined. Your ex can be fined if he has PR, although I would be surprised if the council pursue him in the situation you describe.
