School in year admission appeal

We have just had the refusal of our in year 3 school appeal, in the hearing the rep from LA representing the school referred the chairperson to a school plan and class sizes, we were not sent this info, is this right please

Did you get sent the schools case? This would normally refer to class sizes etc as a standard reason why they can't go over PAN for year 3. It may not have actually been a plan of the school but simply refer to the size of the buildings/rooms etc. Did you raise the issue at the time?

You should have been sent the complete case in advance. However, if it was referred to in the panel discussion and you didn't mention it then, it's a bit late now to raise it. Does the decision letter comment on it?

Any documentary evidence, which would include a school plan, should be circulated before hearing. I agree with PatriciaHolm that you should have raised this during the hearing and asked for time to look at the plan and consider the implications for your case.

You could take this to the EFA (if the school is an academy) or the LGO (if it is not an academy). However, they will only step in if you have been disadvantaged by not seeing the plan before the hearing. If it made no difference to your case it is unlikely you will get a fresh hearing.
