I posted on a different part of the site but people are saying it would be better to post here so I'll add the link to the thread www.mumsnet.com/Talk/am_i_being_unreasonable/2736183-Aibu-to-think-school-refused-a-place-because-of-this?watched=1&msgid=63705818#63705818

Phone the LA.
Ask for every school that currently has spare places in y10.

Pick the one you want and apply and say you want your DD to start immediately (ish).

If none, ask how to invoke the 'Fair Access Protocol'. Point out that it cannot wait until half term as this is the GCSE years.

Thank you for linking it Teen La said they will email me a list so I'm still waiting . Year 10 is such an important year and I feel like they are just playing us about

Not much to add really. The LA should be able to tell you which schools have places available. If none of them are within a reasonable distance from home (which at this age means 75 minutes journey each way) the LA should use its Fair Access Protocol to come up with a place nearer home. Keep chasing them. Don't be brushed off with excuses like having to wait until the end of October before they can do anything. There is nothing to stop them getting involved immediately.

Thank you ,I'm still waiting for them to get back to me with the list of schools. The whole situation is a mess and DD is getting frustrated now,she thinks she will miss out important GCSE work

As everyone has said don't just wait for the LA to provide a "list". Phone schools and ask about vacancies.
