Due to an appalling experience at my ds (8) and dd (5) previous school it was absolutely necessary to remove both the children immediately. Fortunately my ds was accepted into a local school that has amazing SEN provision and is gaining confidence after his trauma.
However my dd application was rejected on the basis of class size; which had 31 (30 plus a "excepted child" due to his statement). A child has recently left, leaving 29 plus 1 and we were really hopeful that a place would offered but sadly not.
The LA is still considering the situation in respect on infant class size limitations and we are due to appeal next week. Our argument is; the class size was increased due to the inclusion of an excepted child and that child has his own funding and TA. Thus my dd place would only replace the child that left at Easter and would join 29 other children who would fall within ordinary provision.
I have read: The Education (Infant Class Sizes) (England) Regulations 1998
but I'm still confused about whether this would support my claim.
As my ds has SEN SA+ and this has been further complicated by the stress and anxiety he has endured at his previous school, it was fundamental that we chose the place we thought most suitable for him and have been home schooling our dd for the past 9 weeks.
This situation is far from ideal!
Has anybody had a similar experience or has a child whom has been offered a place due to being an excepted child.
