defferal dilemma help needed

we are in scotland ds was 4 in late dec want to defer entry into p1 as he has a speech and language problem . we applied for a deferal on the basis that as he has phonological disorderhe would be dissadvantaged in p1 both socially and academically .we were supported in this by both nursery and educational psychologist .the councils own literature states clearly that older children do better in p1 and starting too early may disadvantage pupils .
phoned the council on tuesday to see when deferral letter were being sent out as early years panel had met on friday 4/3 . yesterday morning 9/3 we had a call from pupil placement saying letters had been sent out and they could tell us over the phone that ds's defferal application had been successful . we were overjoyed and told ds that he would be going back to nursery next year .he was delighted .

letter from council arrives this morning 10/3 dated 8/3 saying ds's application has been unsucessful and we would have to reapply to another early years panel in mid may. phoned council spoke to lady i had spoken to yesterday who was very apolologetic and said she had been advised that she could inform us that defferal had been succesful but that at a subsequent meeting they had deceived to change their minds .

needless to say i anm furious more so becuse we've been told one thing and then had it withdrawn etc.

i plan to contact the educational ombudsman ,my msp etc .any other ideas as to where i stand legally etc

Are they saying that you can't defer, or that if you defer you wont get nursery funding?

i can defer legally because he will not be 5 by school starting age in august but won' t get funding for a second preschool year even though he has only had one funded year at preschool startrd in sept 2010 unlike most of his contemporaries who have had 2 years.

The information I have read says that parents of late born children can always defer entry to primary school but they are not guaranteed an additional year of nursery funding, it is at the council's discretion.

i would definitely ask again, because it is not as if you are choosing to do this bacause you can it is because the professionals have advised you that it is in the best intesests of your child. Which council is this? I know that Edinburgh usually do agree to it, but no idea about other councils

i know i can defer his entry into p1 . i'm actually more annoyed by the fact that i was told over the phone he had been given a second (not third)funded year at nursey one day only to be told by post the next day that he hadn't been given an additional year .
