Feel bad but need to return something faulty

I bought something in Dec for my daughters birthday this week
looked ok really nice seller it came I turned it on and off then put it up til her birthday.

She got it for her birthday and we have now discovered lots of things that do not work propery at all to the extent that the thing is practically useless.

I have filed a dispute but feel bad as the seller was really nice but if the thing dos not work I should be able to send it back for a refund?

I thought a dispute was only if the seller refused to give you what you were entitled to...have you contacted them about the faulty item?

it depends how long you ahd it when really you shopuld always check something fully when receiving an item as after set amount of time buyer could have broken it themselves and then wanting to send it back

you should of e mailed firstly the seller explaining the situation and given them the chance to respond before opening a dispute as that is unfair on them as they have had no opportunity to sort things first

really you should always check fully i would be annoyed to find out 2-3 weeks later buyer wants money back they could have easily tried it fully when item received as you should before leaving feedback

I think you should have checked it properly when you received the item. Opening a dispute without contacting the buyer first is not the correct procedure and now that will surely make alot of ill feeling between you and the seller. I am with bubblagirl on this one and would be very unhappy a few weeks down the line if I got left negative feedback.

I have e-mailed the seller and apologised
only had it a couple of weeks and checked that the thing worked initially but did not try out everything and every different aspect the seller was kind enough to charge it before sending it.
but it was hidden and put up for my little ones birthday and only got played with different things yesterday she was soo upset the major faults would not have shown up straight away it is a shame but we have not broke it --the item is faulty I feel bad because yes i should have checked every inch of the item but was too trusting but why should I be £100 pounds out of pocket and my dd3 not have a working birthday present because of my error in judgement and the seller providing an item not in proper working order you can file a dispute up to 56 days after a sale I believe) I am not unreasonable and if it was just a minor problem I would not be upset i would jus work round it. I have not left any feedback yet at all and I have not upgraded it it to a dispute til the seller has had a chance to get back to me. I am a mum of four who sold lots of stuff at 99p on the run up to christmas to pay for this as I do not do this lightly but feel my dd3 has lost out big time.

You really shouldn't have posted an mn thread about this. You know the seller is an mner, you bought it through an mn link!!! She's been here along time. I've known her in rl for a very very long time and I know she would not sell anything which is broken. I think saying you've been too trusting is insinuating that she sold it knowing it was faulty which isn't fair.

Please put all correspondence through paypal from now on as that is what is best for both of you. I cannot understand why you did not contact her before starting a dispute. I've had this happen to me on ebay and it's very very annoying, at least give someone a chance before involving ebay/paypal. I know people get stung by scammers all the time, but unless you go into every ebay transaction believing that the other party is honest I don't think you should use it. I always pay by paypal so I have a backup and could start a dispute if necessary, but I would always give the other party time to reply first, IMO it's just common curtesy.

I'm sorry your dd ended up with a broken birthday present. We are all mums and know how disappointing this would be (I know my dd would be very upset) but unfortunately these things do happen, even if you buy new.

I'm a bit confused as to why you've opened a dispute before contacting the seller?

You really should have checked the item fully on arrival & prior to packing it away. Why haven't you leave FB? You make it sound like you knew something was amiss?

What was the reason for opening a dispute without contacting the seller first? You need to allow time for her to reply & see if you can resolve the issue before going anywhere near a dispute

Depends on what the item is and the fault.

However, if you have had it a while and only just found a problem then whos to say where the problem occured?

The fact you put "but we have not broke it" also made me a little and the fact you went staight to a dispute rather than email the seller doesnt sound right either.
