Buyer claiming my items fake...........

chloesmumtoo · 23/05/2016 10:21

Hi, they have messaged stating my items are fake, they don't want them and about having refund. I replied stating where purchased (Store) and that it is certainly not fake but that they can return item to me and I will refund if in condition as received. However I had no returns set on my listing.
They can still start a return can't they despite my settings on listing? Have never done returns before. I told them to follow the ebay process as not sure how to from my end but nothing has happened. Feel bit vulnerable with my lack of knowledge, any help please......Fear I will be scammed here.
They have not replied since and not sure I can do anything until they start the ball rolling. She has made few neg to other sellers before via her feed backs but has purple star score? Bit baffled really. My items were tagged and in new condition just have been in home for a long while, had 2007 on clothing label.

Some eBay buyers are tricky..... I sold a coat to somebody once and she claimed it smelled of curry, which was a total fabrication because I'd just had it dry cleaned. Anyway, as to your question.... All the buyer has to do is post the stuff back to you and you do a refund via PayPal.
There is a refund button in PayPal.

bewarethewalkers · 23/05/2016 13:03

Sounds like she might be trying it on. Tell her to send it back then when it's received back, if it's in the same condition you can then refund. She may be hoping that you will offer her a substantial partial refund. Was the item expensive?

19lottie82 · 23/05/2016 15:05

If the buyer hasn't been in touch again, then don't contact them.

what was the item? And the value?

There is a common scam where a buyer pretends an item is fake, sends back a counterfeit and keeps the original.

chloesmumtoo · 23/05/2016 15:45

Yes that is what I am thinking Bewarethewalkers, she's trying it on. Value she paid was about £25 so not horrific but don't really want to loose that and the items on top.
Yes I have not made any further contact 19lottie82. The items were 2 items of branded clothing with tags from Sports Shop. Have live chatted to Ebay too but nothing happening yet.

If she confirms she wants to return it, say you will refund once you have checked it's the same item using UV security markings or your detailed photos of the surfaces. You could say that even if you haven't made UV pen marks or taken photos of the detail - you just want to avoid them returning a similar fake to you!

19lottie82 · 23/05/2016 23:28

Yes you're prob right. If it's a low pay value item they're prob after a partial refund.

Stick to your guns and repeat that it's authentic, but tell them they are welcome to return it for a refund if they wish.

19lottie82 · 23/05/2016 23:30

PS yes even if you state "no returns", a buyer can still force a return, all they need to do is open a case with eBay and say the item was misdescribed. eBay will always approve the return.

Gingefringe · 24/05/2016 08:31

Unfortunately I think that if she starts off a dispute by saying the item is a fake then eBay will let her keep the item and make you refund the full amount - please take a look at the eBay guidelines in the 'help' section. (I hope I'm wrong).

You may have stopped her in her tracks though by being very pleasant and offering full refund if the item is returned. Good luck. Some buyers are just trying it on!

sleepwhenidie · 24/05/2016 08:44

Unfortunately it isn't worth having a battle, the system is stacked against you as a seller. Easiest is to offer full refund (good idea about security marking thing as pp said), and chalk it up to experience, try and forget about the lost postage costs, at least you get the items back. SadAngry

sleepwhenidie · 24/05/2016 08:46

And gingerfringe is right-someone did this to me, claimed a genuine item I sold them was fake and they got the item and their money back! I naively fought it though, if I had just offered full refund then I would have got it back I think.

chloesmumtoo · 24/05/2016 09:46

Thanks everyone! Some good advice and info. Will see what happens, fingers crossed I wont hear anymore from them.

ginge that isn't the case.

If a seller claims an item is counterfeit they still have to return it for a refund UNLESS they get proof from the manufacturer or an official dealer that the item IS actually a fake.

Otherwise anyone and everyone could go claiming whatever they wanted was fake and just get to keep it!

19lottie82 · 24/05/2016 12:12

Even if you "fight and lose" then eBay will just tell the buyer to return the item for a full refund, once you have confirmed the return address. Only at the is point, will the seller get to keep the item and get a refund, if you don't confirm the return address.

If you "fight" a case, then yes, you prob will lose (and get a black mark for an unsettled case), but the buyer will still have to return the item for a refund, Unless the seller ceases communications then they will get to keep the item and a refund.

00100001 · 24/05/2016 12:15

I agree call their bluff!

I have people doing this all the time. Last one claimed her account was hacked and she didn't order the item. Told her to go through disputes a and inform eBay of the hacking. Never heard a word more

EscobarsMule · 24/05/2016 15:47

I normally offer a refund if someone isn't happy for their own made up reason - I say something like "sure, send it back and I will sell it to someone else". It's surprising how often they then just keep it.

chloesmumtoo · 25/05/2016 08:59

She put in for return yesterday and said, 'These do not seem authentic brought these for my son and they are to big for a size M and the bottom part is way too wide. I have been told they are not proper nike' Hmm Expected me to fit the return costs obviously. I have buckled and accepted the return just to get the items back from her. Feel bit gutted but don't want her to keep them out of principle. Just hope they come back in good condition now...............

Now she is selling it with my pictures. Dont know what to do

19lottie82 · 25/05/2016 11:31

So looks like she won't be sending them back then. report her listing for using your photos. And add her to your blocked bidders list.

If she leaves you negative feedback stating your item was "fake" report it to eBay and it will be removed as she has no proof.

twofingerstoGideon · 25/05/2016 11:51

Is she offering your item for sale stating it's genuine? If so, she can hardly shout 'fake'!

chloesmumtoo · 25/05/2016 13:16

Thank you! Have been in right fluster. Liv chatting to Ebay. Have reported but did not realize she was using my photos at that point. Told them through chat as it wont let me report agian. I will block her in mo, only just got off chat. Thanks 19lottie82 about feedback info, am worried about that. Yes twofingerstoGideon she is stating genuine

She can't ask for a return then sell your item - unless she is thinking she will get a refund, keep the item and sell it too (massive cheek going on here on several counts) If they have started a return then they should be sending it back. I would be giving ebay CS a call (I find the call back service good and better than live chat),. Sounds like a total PITA buyer.
Do not refund without item back to you and if they leave bad fb ask ebay to remove it. If you have the original receipt for the item upload pic of it to ebay.
