Item not received yet seller has proof I did

Bought a coat on eBay a fortnight ago , hadn't received the item by this weekend so opened a case .
Seller at first agreed to a partial refund but is now saying she has proof that the item has been received as she said she has spoke to the post office and they can confirm they delivered it to my house Confused

I've checked the back garden in case it was thrown over & have asked the neighbours but no sign of it .
Item was not sent recorded just plain 2nd class .

I'm not sure what to do , I have asked to see the proof but she is demanding I close the case Confused

She's trying her luck! What does she mean, she spoke to the PO who said it was delivered? If she sent it second class then there is NO track of where it went or when it is delivered. She's talking out of her arse. Don't close the case. Ebay will find in your favour.

This frustrates me somewhat. I try and avoid eBay now because I sold something on there once and when the buyer rcvd it they said it was not as described (it was but we won't go there) and sent it back. Fine I refunded all the money including additional postage and the buyer still opened a case up after I refunded.

MyPandaisasecretmonster · 18/09/2014 13:34

Autumn she told me what postal service she sent it by which was 2nd class royal mail .

Also my Postman always asks for a signature for signed/recorded items .

If she had proof that I have received it then why has she not sent me a copy of the proof instead of saying that she has forwarded it to eBay so I may as well close the case as I won't get anywhere because I'm obviously lying Hmm.

How do you know she didn't send it signed for?

The OP wrote "Item was not sent recorded just plain 2nd class ."

Even if the OP doesn't know that for certain, as a wild guess I'd say that any seller who has a signed-for proof available wouldn't be relying on "she said she has spoke to the post office and they can confirm they delivered it to my house".

MrsCakesPrecognition · 18/09/2014 13:36

She can't have proof if she sent it standard mail. She is bluffing and you will win any case via eBay. Don't close your case, stick with it. You'll be fine

Jacksonville14 · 18/09/2014 13:48

Autumn - this is why you need to send with online tracking.

And OP - why on earth should you agree a partial refund? You are entitled to a full refund - anything less is daft.

The seller doesn't have proof - she won't even provide proof she sent it. Please do neg and leave low stars too. And her claiming that RM say you had it - well she is clearly hoping you will back down and she will keep your money. Has she relisted the item, either on her id you know or another different id?

MyPandaisasecretmonster · 18/09/2014 14:57

No she hasn't relisted the item .

I'm not going to back down. Thanks everyone

Just received this message from her

'Tried my best to issue part refund but can't find the right way to go about it, what if we try closing the case from your end and as soon as it's closed I then transfer the money to you, , you can trust me to do this honestly. '

nope - no flipping chance. Ignore and wait to escalate. She just has to hit the refund button from the dispute - it isn't rocket science. eBay will already have frozen your funds. And you are due a full refund - not a part one. And if she is talking about transferring the money as a payment that is the incorrect way of doing it. She has to refund from the original payment.

TarkaTheOtter · 18/09/2014 19:15

Why would you accept a partial refund when you haven't received the item? She's trying it on. Tell her full refund through ebay.

SylvieFart · 18/09/2014 19:16

DON'T DO IT. Leave the case open Ebay can handle it, she is trying to pull a fast one I bet.

MyPandaisasecretmonster · 18/09/2014 19:17

I'm just amazed she has the cheek tbh.
and the 'you can trust me honestly' is the least believable line I've ever heard

No no op eBay will refund you don't close the case

TheFilthiestPersonAlive · 18/09/2014 19:19

you can trust me to do this honestly

Yes because she's conducted herself with total decorum up until now.

Hold out for a full refund, for sure.

MyPandaisasecretmonster · 18/09/2014 19:21

I just messaged back saying 'Sorry but from now on I'll be letting eBay handle the case'

When will it let me escalate the case ?

OP posts:
starsandunicorns · 18/09/2014 19:24

Personally I would reply
I haven't got the item you haven't shown me edvicance that it was tracked even though you say it was delivered I will wait for eBay to decide thanks

Jacksonville14 · 18/09/2014 19:27

8 days after opening is when you can escalate - it will tell you in the case - 'seller has to respond by x date' or suchlike.

Itsfab · 18/09/2014 19:28

Whatever she does and says DO NOT trust her.

nauticant · 18/09/2014 19:59

That's a hilarious update OP.

To the thread in general, if a buyer wins a dispute are they allowed to leave feedback referring to the seller's conduct in the dispute?

AWimbaWay · 18/09/2014 20:50

Just wanted to add make sure you only contact the seller through ebay and not your own email so that ebay can see exactly what communication has been made. She sounds very dishonest and a bit dim!

MyPandaisasecretmonster · 18/09/2014 20:53

I have been doing.

When she was messaging me about having spoke to the post office & having proof etc she was just sending me normal messages , though I always replied through the case Smile
