Refund - can I limit period to 45 days?

I sold an item which the buyer is claiming is faulty. The first I knew was when he left neg feedback - grrrrrrr! I actually phoned him to say that if that was the case then of course I'd refund if he returned it. He said he was far too busy and it wasn't worth his while. I left it at that.

Then a month later he emailed me to ask me my address. He didn't ask for a refund but I presume this is what he meant.

I still haven't heard from him or received the item. I have had a look at Ebay customer services and there is something about a 45 day period for returns.

My question is - should I email him to say if it doesn't arrive within 45 days (now 2 days left) I won't refund? Or should I just leave it and hope he really is too busy to get to the post office? I basically don't want to refund him as he's been so awkward with the neg feedback - plus his attitude on the phone was arrogant. What if he returns it in 6 months or something - do I have to refund him? I'm not a shop, just a normal person so I'm quite worried about what I'm obliged to do.

Oh also, am I right about the 45 day thing?

the buyer can only open a case with eBay/Paypal up to 45 days - so I would probably leave it if I were you and do nothing unless you hear from them or the buyer again.

But the buyer saying he is too busy to return, I bet they won't return it as they just wanted a refund and to keep the item. Or maybe I am just cynical?

Thanks for that. I think you are right to suggest I leave it. I think that if I tell them I'm not going to refund then they will get arsey and it will fuel the fire. Just hoping he forgets.

My worry is that the asking for my address was a few weeks after he said he was too busy so he might have decided he does have time. What happens if he does return it though even after 45 days? Do I have to refund him? Technically he hasn't even had the courtesy to ask me for a refund which is so so frustrating. Yes - another bad buyer!

no - he cannot force you to refund after 45 days as he is too late to open a case.

he has already left negative feedback there is nothing else he can do apart from open not as described case , which he has 2 days left then if he wins ( he probably would) he would have to return for refund anyhow
