We are selling off some of DS's old things. Someone has bid on and won an old games console.

The buyer has emailed us to say that he had bid on 2 of these, and won both. As he had already paid for the other, can we relist or offer a second chance on ours.

The next highest bidder is only 50p less so not a big loss, but it's more a principal thing. I thought Ebay rules stated that you shouldn't bid unless you intended to buy? We have offered the second chance but if they turn this down should we start a non-paying bidder case? Can we even start a case as we have already made a second chance offer?

I think I'm mostly miffed for DS. We set up another account for him as I didn't want used stuff mixed in with my shop stuff and he's been enjoying the thrill of watching the auctions, especially as this one went higher than expected.

The buyer is being cheeky. I once bid on 2 identical items and won both and took the hit. I then relisted one and made a slight loss but it was my error. If the second offer in only 50p less go for it as if you reliant it could be lower but if they turn it down, then open a non paying bidder.

open an unpaid item case on day 4, then close day 8 and give the buyer a strike. Once that is done and dusted then you can relist or second chance offer.

We offered the second chance which was declined. So we emailed him and asked him if he wanted to pay for it or for us to open a case.

He replied today basically saying he hoped that we could resolve this amicably and he would leave us good feedback.

My gut feeling is this isn't the first time he's done it, and so he needs to be taught a lesson. Can he leave us a negative if we open a NPB case? Can he leave feedback before paying, becuase he could leave the feedback before the case closes?

no he can't leave a neg after a case - just get it opened. If he does leave feedback before it will be removed.
