What to do about mortgage with ex

Hi, looking for some advice.

My husband has two boys (17&14) with his ex (never married). We have the boys 50/50 plus pay for all expenses (school trips, clothes, social activities etc).

When they split ex stayed in the family home and soon moved her new partner in. When the new partner moved in the agreement was that they would pay the mortgage in exchange for leaving my husbands name on the mortgage as they wouldn’t reach affordability for the mortgage. Fast forward to now, ex can’t afford to pay the mortgage anymore and we can’t afford to either as we have a mortgage and children of their own. I am worried that she will just default on payments but not try and sell the property as they have agreed to sell before but not actually put it up for sale.

my husband has already agreed to a less than 50% split of the equity and that doesn’t seem to have motivated them. Where does this leave us?

to add - they have been paying the mortgage for less than 2 years and they have 2 other children who live in the property too.

Your partner will need to get a solicitor and they can write to her and offer her to either buy him out or agreee to sell. If she doesn’t want either, your partner will need to take her to court for an order for sale to force a sale, equity will be split 50/50 after sale costs unless there is a trust deed.
