Child maintenance reduction for nrp living with other children

I’m wondering if anyone can help regarding the reduction of maintenance for my child as my ex is saying he lives with 2 other children. We have an extremely hostile relationship and he is currently paying no maintenance due to having been out of work. He re-entered employment early this month, but I’ve no idea what or when he will pay me.

I have found out that due to his new role being close to where his affair partner lives, he is staying there a few nights a week. I am also aware that he has done CMS calculations based on him living with her 2 children. He has continued to rent a property in our home town, he has our daughter 6 nights a month.

Is there a threshold he needs to meet regarding the number of nights he needs to be staying at her house to be able to pay the lower amount of maintenance for his own child?

I would think he actually has to be living there with that his registered address

If he says he lives with her for CMS, it is possible that this impacts on her benefits. That assumes she is in receipt of benefits. Is this likely? If so, this might not be a cunning plan for her.

She earns too much to receive child benefit, so I don’t think that would make any difference. I did wonder about council tax though as she’s likely to be on single person discount. I don’t know if there’s a threshold there either though!

Report to CMS and they can request proof he actually lives there, as sleeping over a few nights but keeping another home would not qualify. He needs to live with those children not just be a house guest 3 nights a week.
