My ex assaulted me and my 3 month old baby. I kicked him out and got a non molestation order. For background, I brought him over from another country on a spouse visa. He has since switched over to a parent visa which requires you to have contact with your child so he has filed for contact.

Through out our marriage he has been very abusive, we just had a fact find hearing and waiting for the judge to make his findings. Meanwhile we're going through cafcass to see what they say. My biggest issue is that since breaking up, I have found out from his family that he molested his siblings when he was a teen. Given all this information how likely is cafcass to say no contact?

Has anyone gotten a no contact oder before and what were the circumstances?

It really depends on the outcome of the fact finding hearing.
if the court do not uphold your allegations then he will get contact.
if they do uphold your allegations it depends on the nature and extent of them as to whether he gets contact or not.
his visa status is not a consideration for the court.
do you have evidence that he molested his siblings ?

Yes He is not denying it. And I have a statement from one of his sisters.

I have a no contact order. We didn’t have fact finding because he made admissions of harm. Following this we had a section 7 assessment which took about 3months. To manage your expectations, be prepared that even with admissions/findings of harm they still may recommend some form of contact.

@Buscake we are about to begin the section 7 process now with cafcass. did yours end up getting some form of direct contact? Currently contact is indirect.

No I have a final order which says no contact whether direct or indirect. I am told this is a very rare outcome. Good luck with the section 7 - be open, be honest, remain child centred.
