Ex hasn’t paid CM for 3 weeks

I am my disabled sons primary carer and he claims DLA - high rate mobility and high rate care(DLA is in my name)

My ex has our son for two nights per week, these last few weeks he’s only had him for 1 night per week. Ex seems to think and encourages our other child to say that I’m “rolling in it” The DLA is paid into our old joint account and I’ve made the mistake of not changing it over to a solo account so ex can check the balance.

He seems to have the attitude that our sons DLA payments should replace any CM payments and that I don’t need it.

I have always offered to share the DLA and this Christmas sent him £300, I have also offered to use the money to replace a carpet that our son damaged in his house.

Should DLA replace CM? DLA is for extra costs related to his disability but ex doesn’t see it that way.

No, get the account changed and claim CM through CMS.

Change the account asap.
Put in a claim to child maintenance, they will tell him what he needs to pay.
Time to tell your ex very little, and start documenting his behaviour such as telling the kids about money- talking to the kids about adult issues and affecting their relationship with you is not acceptable.
Only speak to ex in writing.
