Hello,

I would like to know from those who have gone through separation / divorce and who received inheritances and or gifts during their marriage, how were these split at divorce in terms of financial agreements?

I'm going through this currently, and it is a marital asset - so ex-spouse is technically entitled to half of it

I believe it depends on how long ago the gift/inheritance was, and particularly whether you/he put the inheritance into joint funds or kept it separate. You need more in depth information and you would have to give much more information to get a useful answer

It also depends whether the spouse can establish a 'need' to claim on it. If its not a 'needs case' (there are enough other assets to meet needs) then the chances of the gift staying with the person who received it is higher. Also depends how recent.
