I am planning on separating my husband and hoped to get some advice around our property before I set the wheels in motion.

we are based in Scotland. Married for 11 years, with 2 teenage boys. We Own our home with a mortgage, remainder of the mortgage is £33,000 and property is worth around £100,000.

We built an extension four years ago which my parents paid for and I also own my parents home which they signed over to me 6 years ago.

I would like to stay in the home with the children and I wondered what my options would be to buy him out. The house value increase is due to the large extension that my parents paid for would I still need to give him half the equity.

How does the law look at this situation too as he is adamant he is not leaving but it was my house first and he moved in with me and we then got a joint mortgage?

You need a property solicitor as it sounds like it has the potential to be complicated.

Have you got any ring fencing of the extension money and your mum's house?
Not sure if Scottish position but potentially your stbxh will have potential claims on your second house.

Are you in a position to offer them a substantial lump sum?

There's a risk he's going to go after your parent's house too. You need proper legal advice from a Scottish lawyer.

You can get something in place where he has to leave and he will not be able to come near you anyone ordered
