Moving out- who pays for what?

Hi,
Have some legal advice booked later in the week but just wondering in the meantime if anyone knows please.
When a married couple who are joint tenants on mortgage separate pre divorce, if one moves out into rented accommodation while awaiting house sale, who normally pays for rent and mortgage during this period, are they both joint costs or is the person who moves out meant to cover rent plus half the mortgage?

There isn't a normal.

The person who moves out into rented obviously is the only person on the contract for the rent.

The mortgage is jointly liable.

I’m in this position at the moment. STBEX has moved out (living with his mum but going to have to rent realistically)
He pays half of the mortgage as he’s still named on it.
He doesn’t pay anything towards bills but he pays me child maintenance which basically pays my whole mortgage altogether and I pay for everything else.
He then has enough money to rent and pay the bills on another property until a decision is made regarding the marital home.

Exh still paid half the mortgage until the house sold. I have no idea where he was living but I certainly wasn't going to contribute to his living expenses.

My STBXH has moved out. I currently cover the whole mortgage even though still in joint names, he moved into staff accommodation with his job and pays peanuts for rent. He did put the deposit down on the house though initially and I’m the main earner so this works for us.

Thank you.

I think it depends on your circumstances. When XH moved out, he went into rented accommodation and I covered the mortgage (similar costs) with a view to me taking over the mortgage when the finances were separated.

When I moved out I paid all my rent and ex paid all the mortgage

The mortgage and rental costs were the same

He would have owed me rent on my half of the house for having sole usage, I would have owed half the mortgage, so we called it quits

It depends on how much of an arse your STBX is. I got stuck with everything, but ultimately it worked in my favour.

millymollymoomoo · 30/09/2024 19:28

Totally depends on your circumstances and earnings and ability to pay etc

Thanks everyone.
