Sell house / finance order - which way round

hi all… can anyone tell me the implications of selling the house before the finance order approved?? If we have decided a split, very amicable, can we proceed with house sale and subsequent purchases in the interim?

There is always the risk it won't be signed off by the judge.

Definitely sort the FO first. I’m in a really tricky situation because we haven’t done things that way round.

I sold before consent order was signed

no issues

but depends on whether there’s likely to get anything contentious or questionable in consent order and whether your ex is likely to change mind/disagree/ etc /

Sometimes the proceeds of the house might not be even to reflect one of you keeping your whole pension or having a ringfenced deposit etc

I'm having a similar dilema as ex is pushing for the house to be sold but no financial order in place yet. My solicitor has suggested that the house can be put on the market once we have agreed how we wish to split our finances, then the paperwork submitted to the court but it is really important non to exchange contracts with buyer until the order had been approved by the courts.

Thanks for your reply! Yeah sadly i have come to that conclusion too!! Really frustrating as we are going to have wait at least 6 months it looks like as divorce application has only just gone in
