Reverting to maiden name after divorce

wtfisthisplease · 18/07/2024 16:45

Forgive my naivety but how does one go back to legally using their maiden name? My final order does not have my maiden name on it so can it be used as proof or do I need to do this by deed poll?! Thanks

Yes by deed poll, I did mine before the divorce was finalised.

Pretty sure your birth certificate and divorce certificate should be enough to change it back not that you should need the divorce certificate as your 'maiden' name never actually stops being your name but whatever we live in a sexist society

Also deed poll can be free - I just printed something out and got it signed by one or two (I forget) witnesses. Don't get suckered into spending money on it.....

I have this same issue. It looks like doing a Deed Poll is the far easier option rather than using birth certificate and Final Order. Rather annoying as the Final Order cost me £5k!!

Pieceofpurplesky · 19/07/2024 15:11

Deed poll for legal reasons. I waited till DS was 28 purely for passport reasons when travelling.

I'm not sure you need a seed poll. IIRC, your maiden name is always your legal name. Using your married name is a social convention and legally recognised, but doesn't alter your inherent right to use your maiden name.
A bank etc just needs to know that you are you. Being able to show documentation which tracks the change, so bc, divorce cert should be sufficient.

Ive been changing my name back and haven't needed a deed poll. Just final order and birth or marriage certificate is fine.

HappyAsASandboy · 22/07/2024 10:28

I am married and use both names. If you want to use ID in one name with a company that uses your other name, use your marriage certificate to show both names are the same person.

There's no reason this won't work as a divorced person too. Just contact the companies that use your married name and say you want to revert to your maiden name and send them your marriage certificate and birth certificate to show that Mrs X = Ms Y and they should change the name on their records.
