DH and I recently separated. He’s currently in our home where we are joint tenants and me and our 2 DC are staying with family. DH cannot afford to stay there, he has little
money, no permanent job and won’t pass a credit check. I can afford to stay in the tenancy with the kids and would really like to go home. I’d help him with a deposit/some rent upfront if he would go, but that won’t get over the issue of his bad credit. How am
I going to get him out?

You apply for divorce. Then You will have to sort out the finances. 50/50 on assets is the starting point. So the equity in the house would go in the pot for example. Will need to involve solicitors/mediators. You haven't put much info in your op but the house is probably half his so he needs to get half the equity. We need far more info to help you really op.

Thank you @arethereanyleftatall its a rented property. He can’t stay there and I would like to go back with the children but I think he’ll just stick his head in the sand and hope it all resolves itself. I’d help him find something big his financial situation being such that it is I think his options must be limited. We’ve no shared assets, no property, no savings.

How old are the children op and how will their care be split?

5 and 7, at the moment I’m not sure how care will be split, I suppose some of it will depend on whether he can find somewhere to have them overnight. We’ve only recent spilt, he’s had one of this children for tea a couple of evenings and for a few hours one day on the weekend.
