Have I done my divorce right?

Hi,

I applied for my divorce without a solicitor. We are at the final stage now.

Do you sort the finances after finalising the divorce or have I done it wrong?

If its after you finalise how long do we have to sort the finances? We have children together and I'm still in the martial home

You will need a financial settlement so that neither of you have claim over the other financially in years to come. Have you both agreed what will happen to your finances, the house etc or are you still trying to work out between yourselves or do you plan to apply for the court to decide? If you have already agreed then you need to get it written up by a solicitor and I think it is then submited to the court before the final order is applied for or at roughly the same time. You are best sorting your finances as soon as you can.

I'm nearing the end stages of divorce too. I applied for the conditional order last year back in July I think, and so am able to apply for the final order at any point now but we are still negotiating the split of finances. My understanding is that it is best to wait and not apply for the final order until the financials are sorted.

Do the finances before the Final Order, otherwise you have no leverage.

My worry is that he applies for the final order before we sort the finances.

We don't agree on finances. I'm disabled and don't work. Everything is in his name and we have 3 children together.

The final order can be applied for now. Will it affect me if he applies for the final orfer before the finances? He is much more clued up on this than me so I have no doubt he will apply for it if there is financial gain for him.

Or can I apply to cancel the divorce without him having to agree to cancel it so I can sort finances first? I was the one who submitted the divorce.

You need a solicitor urgently.

You may be able to find one that will take fees out of the final settlement if you don't have money right now.

Please see a solicitor as you are leaving yourself very vulnerable by the way this has been done.

You apply to postpone the final order until finances are resolved. You will need at least some legal advice to sign off finances.

If he applies for final order you respond and say you have yet to reach a financial settlement and request an extension to the final order to allow fiancés to be sorted.

If you want to stop husband from applying for the final order you can apply for a stay order, if you want a stay on the divorce proceedings until your finances are sorted you could submit a D11. A judge will then decide to grant a stay so that no parties can apply for the final order until the finances have been finalised.

Have a look at the gov website, or I think there is a number you can call if its not clear, they are very helpful and understanding.
