Divorce buyout/selling query...

Hello! Just a quick one. First post here.

Haven't started our divorce process yet, but we are organising our house first.

The plan is to have my partner's brother buy my share of the property for 10k. We are happy and agree with that, although it should really be around 15k. To be honest, I don't want to uproot them and lose the house but I am happy to move out with a smaller buyout.

When it comes to the consent/clean break, do you think a judge would accept this arrangement as fair? Even if we both agree to it and have it documented thoroughly. I just don't want them to force more money to be paid, or reverse the buyout.

Does it make more sense to sell the property then we can both start afresh on even terms? I am worried about the reaction I'll get for suggesting this...

Also, if we do sell and move out, would you recommend renting/living with family until the consent is finalised/granted, just so that a new property wont count as another asset?

I'm pretty sure that if you purchase a new property before any settlement is done, it may be considered an asset so yes maybe hold off on that. Also as long as you get a clean break order you should be okay in the future and shouldn't be forced to pay more or be dragged into financial disputes etc.
