To get an court order to get ex out

How do i get a court order to get my ex out of the house. Both names are on the mortgage.

He is mentally draining me. Bullying me to the point where I've lost alot of weight in a month due to not sleeping and not eating. I feel so depressed.

He wont contribute anything toward the mortgage in the past year.. Im paying it all but its causing alot of stress and he wont move out. He got an gambling addiction.

It is a strain on everyone inc the kids. I need to protect my kids as one of them is SA.

Does he own half the house? I presume so?

You’d have to apply to the court for an occupation order if both names are on the deeds ( not mortgage)

are you married?
what is the plan for the house and did him to get his share ( if there is equity in it ?)

Just be ware that you do not get the occupation order that easily. I went that route and had to withdraw as the court wants to see evidence that you and the children are at immediate risk. Also the occupation order is temporary 6 months or a year so not a long term solution.
He contested it and it was going to a trial which took 6 month for the first hearing and then the trial would have taken few more months and stress. I am dealing with it via financial order with is another nightmare but I’m doing it myself as I can’t afford a solicitor.
