So an update to a previous post, my sister and husband are 100% going for a divorce. In the last 24hrs he has said he wont go for 50% the house even though legally he is entitled to due to to the fact that she bought the house well before meeting him and paid of her ex and paid off numerous years of the mortgage before meeting him, she has stated that she wont go for his pension. So they have come to a fair decision in my eyes.
They want the quickest divorce route and looking online the choice is an online "quickie divorce" which i know is the wrong term or use a traditional office based solicitor. They want the fastest divorce route with a clean break order.
Would the more knowledgeable people on here recommend the "online quickie" or an office based solicitor? The cost seems to vary, approx £1200 for online for both parts of the divorce or £1800 just for just the divorce part with the office solicitor and then an unknown cost for the clean break order, but quoting £200+ per hour for that part.
Also he has run up massive debts that he wont disclose to her, all in his name, shes not on any finance agreements or joint credit cards, they have separate bank accounts too, we think its crypto and gambling... he's not on the mortgage so would he not be able to secure debt against the house? Can he leave and take all his own debt as part of the clean break order.
Is she liable for any debt thats solely in his name on his credit cards and his finance agreements that she is not named on, i've just googled it and some say yes she is as its matrimonial debt and some websites say not
