Who decides if you pension split or take a lump sum

We’ve had our pension report in and we’ve got figures for both a pension share and also an amount I’d get if I took a lump sum.
If we go to court who decides which option we take?
I’d like a lump sum, my H wants a sharing order if he’s made to share his pension.
Or does a judge decide?

Dies he have enough liquid assets to give you lump sum cash instead of pension sharing? And still have enough left over to house himself etc ?

A lump sum is one off, a pension share is money forever

My husband gave his ex, at her demand, a lump sum, in 5years he will have got back when he paid her and will continue to have his pension sum for life, I will have half if I survive him.

Couple of things

oension cat are can mean you get a pso, an amount is transferred to a pension fund of your own or it can mean a share of income in his retirement

or it can mean instead of a pension share you want to trade and offset that for more liquid cash asset lump sum now

I want to offset.
He doesn’t want to do either but will want the other option ie to put in my pension fund if forced.
We’re not talking a huge amount.

Out of curiosity what the amounts?

I would think a cash sum would be less than pension as it tax free accessible cash.

a pension would be tied up until retirement and be taxable when you draw it.
