Will his new property be part of divorce?

My H and I are separated and have been a long time but are not formally divorced. He bought a second property with money leant to him by family (so not our joint savings) where he lives with his new woman.
I haven't signed anything to say the property is nothing to do with me but he says it isn't because he didn't use joint money for the deposit and so it won't form part of the divorce settlement.
Is that true or will it have to be included?

I bought a house and am not divorced, when I spoke to a solicitor about it, she in fact said I had done the sensible thing with my money. She then said he could try but the judge is most likely to tell him where to go. Also he has never lived here, never paid a penny towards it.

If you have no intention of going after it why even bother trying to find out if you can?
